We are pleased to welcome you to THE DIECAST CLUB website, a brand of Direkt Collections SA. All parts of this website are governed by French and European Union law.
According to article 1369-1 of the French Civil Code, the Terms and Conditions in French is the only legally applicable version. This English translation is provided for informational purposes only.

ORDER PROCESS
For detailed instructions on how to place an order, please refer to the information provided in each of our offers.  Only persons over the age of majority and with full legal capacity are permitted to place an order.

1. PLACING AN ORDER
Only persons aged 18 or over and with full legal capacity are permitted to place orders on The Diecast Club website.
Before confirming your order, you will have an opportunity to verify and correct your order as well as the information you have entered.
The personal information we ask you to provide is necessary for processing your order and for customer service. It may be transferred outside the European Union for this purpose only. In accordance with the amended Law on Information Technology and Freedoms of 06/01/1978, you have the right to access, modify, delete and cancel your nominal information. To find out how to exercise this right, please refer to the "Privacy Policy" section of this website and follow the instructions provided.
The products proposed on The Diecast Club website are available for purchase for as long as the offer is online and while stocks last. If the selected product is not available, the Publisher is committed to informing you at the time of ordering or as soon as possible after.  The product you ordered will be sent to your address as soon as it becomes available again.
The Publisher reserves the right to cancel or extend a collection at any time.  The gifts presented in the offer may be replaced by gifts of like nature and value if the original gift items are no longer in stock.
Subscriptions are concluded for 12 monthly deliveries.
Direkt Collections is free to supplement, modify, correct or delete all or any part of the present Terms and Conditions.  However, the applicable terms and conditions of sale remain those that were in force at the time the order was placed.

Terms and dates of delivery
All orders will be delivered within 4 weeks of the date of the paid order.
The delivery address will be the one provided with your order.  In case of error or omission, particularly with regard to your e-mail address, your order will be voided.
If the gifts presented in the offer are no longer in stock, the items ordered will be delivered to the Client without the gifts but within the stated timeframe so as to avoid any delay in the Client's collection.  The missing gifts will be delivered at a later date, either with the next package, or separately if the Client has finished his or her collection in the meantime.
The post office is responsible on my behalf for the transport and import procedures for goods ordered from Direkt Collections, of which I am the beneficiary and at no extra cost to me.

2. PRICES
Prices are indicated in Euros and are inclusive of taxes (VAT in force on the date of ordering).
Direkt Collections may change prices according to economic circumstances at any time.

3. TERMS OF PAYMENT
Unless otherwise specified in the relevant offer, the Client pays when ordering the product. Accepted payment methods include credit card (CB, Visa, Mastercard, Eurocard) and direct debit. Direkt Collections doesn’t charge additional fees on credit card payments. Additional fees may be applied by the client’s bank.

4. YOUR ACCOUNT
Clients’ connection data is saved in the interest of improving the usability of the http://diecast-club.com website.  If you do not wish this data to be saved, please refer the "Cookies" section of this website and follow the instructions provided.
You can check the status of your orders, payments and returns, or change your mailing address by contacting our Customer Service on +431305047711 (international call charges may apply from your location) Monday through Friday, from 9 am to 6 pm.

5. WITHDRAWL PERIOD
Independently of the withdrawal right defined under French Consumer Law (Articles L121-20 et L121-20-2), if you are less than completely satisfied with the items you have received, you may return them within 14 calendar days from the date of delivery by mailing them to the return address indicated on the delivery slip, without giving a reason for your decision and with no penalties. Please note that the Client shall bear all costs incurred for returning packages.  Please mail returns to the following address:

Please note that the product must be sealed and in its original packaging.
If the Client returns a product without cancelling his or her collection, Customer Service will nevertheless suspend the collection and inform the Client.

6. CANCELLING DELIVERIES OF A COLLECTION
The Client who subscribed to a collection is under obligation to purchase a minimum number of 12 monthly deliveries. He is free to cancel his or her collection at any by informing Customer Service (by letter, e-mail or telephone) and indicating his or her address, client number and the relevant collection.  The cancellation of the Client's collection will become effective as soon as it is registered by Customer Service. The Client must pay for all items delivered before the date of cancellation, provided he or she wishes to retain them.  If the Client receives a package after informing the Publisher of his or her decision to cancel the collection, he or she may either keep it, in which case payment is due, or return the unopened package marked "Refused" to a post office, or mail it to the following address:  Customer Service Department – Direkt Collections, Swiss Mail Solutions (Austria) GmbH Industriestrasse 7 3130 Herzogenburg Austria   If this is the case, the Client may request reimbursement of shipping costs. Simply contact Customer Service and provide a receipt. Reimbursement will be effected only after receipt and registration of the returned package.
Please note that shipping and processing of returns can take time; accordingly, between the date when the Client returns or refuses a package and the date when Customer Service processes the return, the Client may receive a payment reminder. If this is the case, the Client should contact Customer Service and explain that the package has already been returned.

7. INTELLECTUAL PROPERTY AND NEIGHBOURING RIGHTS
The Diecast Club website and all its constituent elements, including various types of content (photos, text, presentations, names, titles, brands, drawings, models, etc.) and related software are protected by intellectual property rights and neighbouring rights and reserved for rights holders.
Consequently, all use, reproduction, representation or distribution of these constituents elements, in whole or in part, is strictly forbidden, except in the case of reproductions without modifications or distortions made for personal and private copy only, in accordance with article L.122-5.2° of the French Intellectual Property Code.

9. WARRANTEE
Direkt Collections commits to delivering products that comply with those presented on its website.  However, they may occasionally differ slightly (particularly in colour, shape and order of appearance).
The Publisher is responsible for assuring product compliance.  In case of non-compliance, the Publisher commits only to replacing the defective product.  Clients are invited to contact Customer Service to find out how to request a replacement.  If replacement is not possible, the Publisher will reimburse the purchase cost of the defective product.
The Client must observe the relevant conditions of use of the product and is solely responsible for any direct or indirect damages of any kind resulting from any use of the product that does not to comply with the Publisher's directions.
RESPONSIBILITY
Despite the care that has gone into the creation and maintenance of this website, it may contain errors, inaccuracies and omissions; Clients may also experience connection problems or interruptions when connecting to the site.
Direkt Collections is not responsible for any direct or indirect loss or damage arising from this.
Hyperlinks on this website may redirect you to external websites.  Direkt Collections is not responsible for the content of external sites to which you may be redirected, and over which it has no control.
APPLICABLE LAW AND JURISDICTION
All orders placed on the website http://diecast-club.com are subject to Swiss law.
In case of dispute, the Court of Geneva has sole jurisdiction.
